Desde hace tiempo, en Escocia, se esta valorando el crear unas leyes específicas para regular la intervención de los hinchas en la gobernanza y la propiedad de los clubes de fútbol, a través de los Supporters Trusts, tras lo sucedido en los últimos años en los cuales se ha visto la desaparición y la administración controlada de varios clubes y donde la única respuesta positiva ha sido la intervención de las asociaciones de hinchas.
Empezando por el Rangers FC, donde los hinchas han sido decisivos para alejar al especulador Mike Ashley, pasando por el Motherwell FC, East Fife FC, Heart of Midlothian o al Dunfermline Athletic FC, entre los casos más recientes donde la intervención del hincha ha sido decisiva, y la asociación o trust ha sido fundamental para la salvación de clubes históricos. Todo esto ha empujado al Gobierno a crear un reglamento ad hoc que garantice unos derechos específicos a los colectivos democráticos y a los representados de estas asociaciones para ayudar a mantener sano su club
En el ámbito del Community Empowerment Bill, iniciativa de legal en discusión para reglamentar y favorecer la compra de bienes de interés público, el Ministro de Deporte, Jamie Hepburn, en colaboración con Supporters Direct Scotland, ha lanzado una consulta pública para conocer la opinión de los principales sujetos implicados y valorar cuales serán las mejores soluciones que serán incluidas en la futura legislación.

Jamie Hepburn, Minister for Sport, Health Improvement and Mental Health, said:
“I believe that football clubs are stronger when supporters are involved in the way they are run. The Scottish Government is committed to ensuring that fans have the chance to be involved wherever possible.
“It’s important to increase supporter involvement, but we also need to consider the long term stability of our clubs. We must make sure that whichever option we pursue does not result in any unintended consequences.
“This consultation is about gathering a wide range of views so we can decide the best way to achieve this. I want to hear from fans, supporters’ organisations, players and the clubs themselves – anyone who cares about this great game.”
Tema de la consulta, que se extiende hasta el 15 de enero de 2016, será el estudio y valoración de las diferentes vías identificadas para regular la participación en clubes en particular:
- A Right to Influence – to enshrine the rights of supporters to influence their football club.
- A Right to Govern – to give supporters a right to govern their football club.
- A Right to Bid – to give supporters the right to bid for their football club in the case of its sale.
- A Right to Buy- to give supporters the right to buy their football club.

Consultation launched to give fans greater voice
A consultation into the best ways of increasing supporter involvement in football clubs is being launched today.
The Scottish Government is launching the exercise to inform potential future legislation to protect the rights of football fans. The consultation, which will run until 15 January 2016, seeks to gather the views of supporters and other stakeholders involved in the game.
Respondents will be asked to consider a number of different options that could be included in future legislation. These include a right to influence the way the club is run, to govern the club or to bid for ownership when it comes up for sale. The final option is to introduce a right to buy, where fans would have a right to buy their football club.
The Community Empowerment (Scotland) Bill was passed by the Scottish Parliament in June 2015. As part of the final legislation, the Scottish Government gave an undertaking to consult on a range of different options to enhance supporter involvement in football clubs.
